On Tuesday, May 15, contractors, building owners and advocates from across the state gathered in Albany to lobby for Scaffold Law reformation. NYS Labor Law sections 240/241 impose “absolute liability” on contractors and property owners for gravity-related injuries during construction, repair or demolition work, while holding parties that have no supervisory control over the project liable for elevation-related injuries. Those in favor of reform argue that the law has led to exorbitant insurance and construction costs as the number of cases against contractors and owners rise. Advocates are also calling for common-sense reform that assigns liability in proportion to actual fault, giving liable parties the opportunity to defend themselves in court.
